Effective Date: 1st July 2025
These Terms of Business (“Terms”) govern the purchase and use of the maritime simulation product (the “Simulator”) operated by Maritime Professional Development Dorset Ltd trading as Maritime Professional Development UK (“MPDUK”, “Provider,” “we,” “our,” or “us”) and hosted on Amazon Web Services (“AWS”). By purchasing access or using the Simulator you (“User,” “you,” or “your”) agree to be bound by these Terms.
- Definitions
1.1 “RYA Radar Course Simulator Credits” (“Course Credits”) – an 8-hour access licence to the Simulator, for students or instructors, on the day of an approved RYA Radar Course.
1.2 “Simulator Hours (Instructor)” – blocks of pre-purchased time that may be used for practice, general simulation training and to deliver the RYA Radar Course by Instructors when delivering the RYA Radar Course. These hours cannot used by students undertaking the RYA Radar Course. These hours are purchased either by the Instructor for their own use or by the Centre for the use of one or more of their own instructors.
1.3 “Simulator Hours (Student)” – blocks of pre-purchased time that may be used for practice by students. These hours cannot be used by students as they undertake the RYA Radar Course and are intended to facilitate post course development and training by students. These hours are purchased either direct by the student or by the centre on the student’s behalf.
1.4 “AWS Platform” – the Amazon Web Services infrastructure on which the Simulator is hosted.
1.5 “The Centre”- An RYA Recognised Training Centre.
- Scope of Services
2.1 The Provider grants Users a limited, non-exclusive, non-transferable right to access and use the Simulator, subject to these Terms and any technical documentation or instructions supplied.
2.2 The Simulator is provided solely via the AWS Platform; Users are responsible for ensuring they have the necessary internet connectivity and equipment to access the Simulator.
- Purchase and Access
3.1 Course Credits and Simulator Hours are purchased in advance through the Provider’s designated e-commerce system or via a ‘Trade Shop’.
3.2 Course Credits provide access for one eight-hour session on the specific date of the booked RYA Radar Course only. They expire at the end of that session and cannot be carried forward or exchanged for Simulator Hours.
3.3 Simulator Hours (Instructor) may be purchased in blocks and used for general simulator training and can be used by the Instructor to deliver RYA Radar Courses but cannot be used by the Student as their means of accessing the simulator for the RYA Radar Course. A student undertaking the RYA Radar Course must access the simulator using a ‘Course Credit’.
- Fair Usage Policy
4.1 Course Credits are intended solely for the delivery of RYA Radar Courses. ‘Simulator Hours (Instructor)’ or ‘Simulator Hours (Student)’ are intended solely for Instructor use or by students after completing the RYA Radar Course for ongoing training and practice.
4.2 Users must not:
- Share or distribute Course Credits among multiple students; each purchased Course Credit is for one student only.
- Circumvent or attempt to circumvent booking or monitoring systems.
4.3 The Provider monitors user activity within the Simulator (including session logs, usage duration and course activity) to ensure compliance with this Fair Usage Policy. Monitoring is undertaken in accordance with our Privacy Policy.
4.4 If the Provider determines that Simulator Hours have been used to deliver an RYA Radar Course, or that Course Credits have been used by multiple students or otherwise misused, we may:
- Immediately suspend or terminate the User’s access to the Simulator, and/or
- Cancel remaining Course Credits or Simulator Hours without refund.
- User Responsibilities
5.1 Users are responsible for their own network connection, hardware and software compatibility with the AWS-hosted Simulator.
5.2 Users shall not:
- Reverse engineer, copy, or modify the Simulator or any related software.
- Introduce viruses, malware or other harmful code.
- Use the Simulator for unlawful, fraudulent or abusive purposes.
- Intellectual Property
All intellectual property rights in the Simulator, including its software, content, graphics and branding, remain the exclusive property of the Provider or its licensors. No rights are granted other than the limited right to use the Simulator in accordance with these Terms.
- Data Protection and Privacy
7.1 Personal data collected during the purchase and use of Course Credits or Simulator Hours will be handled in accordance with the Provider’s Privacy Policy.
7.2 User activity is logged for the purpose of enforcing the Fair Usage Policy and ensuring compliance with RYA Radar Course requirements.
- Fees and Payment
8.1 All prices for Course Credits and Simulator Hours are stated exclusive of applicable taxes unless otherwise indicated.
8.2 Payments must be made in full before access is granted. Unused credits or hours are non-refundable except where required by law.
- Suspension and Termination
9.1 The Provider reserves the right to suspend or terminate access to the Simulator immediately and without refund if:
- These Terms, including the Fair Usage Policy, are breached; or
- User activity is deemed inappropriate or detrimental to the Simulator’s operation or reputation.
9.2 Upon termination, all rights to use the Simulator cease and any remaining Course Credits or Simulator Hours are forfeited.
- Service Availability and Disclaimer
10.1 The Simulator is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose or uninterrupted operation.
10.2 While the Simulator is hosted on the AWS Platform, the Provider cannot guarantee continuous availability and is not responsible for AWS outages or internet connectivity issues.
- Limitation of Liability
To the maximum extent permitted by law, the Provider’s total liability for any claim arising from the use of the Simulator is limited to the total fees paid by the User for the relevant Course Credits or Simulator Hours. The Provider is not liable for indirect, consequential or incidental damages.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- Amendments
The Provider may update or revise these Terms from time to time. Any changes will be notified on our website or booking portal and will apply to future purchases and use.
By purchasing or using Course Credits or Simulator Hours you confirm that you have read, understood and agree to these Terms of Business, including the Fair Usage Policy.
